Terms and Conditions for BharatBIM

Welcome to BharatBIM! By accessing or using our website (www.bharatbim.com), services, or applications (hereinafter referred to as "Platform"), you agree to be bound by the following Terms and Conditions. These Terms and Conditions govern your access to and use of the Platform, and by continuing to use the Platform, you signify your unequivocal acceptance of all the terms set forth herein. If you do not agree with any part of these terms, you must immediately refrain from accessing or using our Platform or any related services.

1.Definitions

  • "BharatBIM" refers to the entity operating the Platform, which includes its website, mobile applications, educational offerings, and associated digital platforms.
  • "User" or "You" refers to any individual, entity, or organization, regardless of its nature or affiliation, who accesses the services, courses, resources, or materials provided by BharatBIM. This includes but is not limited to students, mentors, and any third parties accessing our Platform.
  • "Mentor" refers to any professional, instructor, educator, or trainer affiliated with BharatBIM who delivers educational services, instructional content, or training materials in alignment with BharatBIM’s objectives.
  • "Services" refer to all offerings provided by BharatBIM, including but not limited to online training courses, live sessions, recorded courses, workshops, certifications, digital resources, and any other learning tools or support materials made available through the Platform.

2. Eligibility

Students:

  • In order to enroll in any course or program offered by BharatBIM, the following eligibility criteria must be met:
    • You are required to provide accurate, truthful, and up-to-date personal information during the registration process. BharatBIM reserves the right to request verification of such details at any point during your association with the Platform.
    • You must agree to comply with all applicable rules, policies, and regulations established by BharatBIM for the use of its services. Failure to comply may result in immediate suspension of your account, and in some cases, permanent termination of access to the Platform.

Mentors:

  • Mentors associated with BharatBIM must fulfill the following criteria to be eligible for inclusion in our teaching team:
    • You must possess appropriate educational qualifications, including but not limited to degrees, diplomas, or certifications relevant to the domain in which you are being hired. Alternatively, professional experience of a comparable standard in the relevant field will be considered.
    • You must demonstrate a proven history of high-level expertise, dedication, and a pedagogical skillset that aligns with the standards of BharatBIM. Mentors are expected to show proficiency in delivering clear, structured, and engaging content.
    • You must sign a formal agreement with BharatBIM that outlines your specific responsibilities, expectations, and obligations. This agreement may include clauses on confidentiality, intellectual property, and exclusivity, which must be adhered to at all times.
    • Mentors are required to work exclusively with BharatBIM for educational services within the domain they are contracted for. Any engagement with competing educational entities or institutions, either directly or indirectly, is prohibited throughout the duration of the mentoring contract.

3. EMI Payments

Payment Structure:

  • BharatBIM offers the option for EMI (Equated Monthly Installment) payments to allow students to spread out their financial obligations over time. Students opting for EMI must explicitly agree to the full payment schedule at the time of enrollment. Payment terms will be outlined in the payment agreement, and failure to comply with these terms will be regarded as a breach of contract.
  • The EMI schedule will clearly state the due dates, installment amounts, and the method of payment. The payment may be made via online modes including credit cards, debit cards, bank transfers, or other methods as specified by BharatBIM.

Consequences of Non-Payment:

  • Students who fail to remit payments as per the EMI schedule will face immediate and severe consequences, including but not limited to:
    • Temporary suspension or complete revocation of access to all learning materials, including class recordings, live class participation, assignments, and any supplementary resources available on the BharatBIM Platform.
    • An imposition of a penalty fee or late charge, which will be outlined in the payment agreement and may vary based on the length of the delay or frequency of non-compliance.
    • BharatBIM reserves the right to report overdue payments to credit agencies, which may affect your credit score and financial standing.
    • In extreme cases, BharatBIM may initiate legal proceedings for breach of contract, including but not limited to civil litigation, where the student will be liable for any legal costs, attorney fees, and additional penalties arising from the non-payment.

4. Rights and Obligations of Mentors

Obligations: Mentors who join BharatBIM as part of our academic framework must observe the following set of obligations and duties:

Content and Delivery:

  • You are required to deliver educational content that is of the highest quality, adhering to the syllabus, teaching methods, and schedules defined by BharatBIM. Any deviation from the prescribed curriculum without prior consent will be considered a breach of contract.
  • You must ensure that all teaching methods and content align with the ethical standards and educational policies outlined by BharatBIM, fostering an inclusive and professional learning environment for all students.

Confidentiality and Exclusivity:

  • You must maintain strict confidentiality regarding all student data, proprietary content, course materials, and any other information shared within the course or Platform. Breaching confidentiality will result in immediate termination of your contract and potential legal action.
  • Exclusivity Clause: During your association with BharatBIM, you are prohibited from engaging in any competing activities, including working with other educational platforms (online or offline), creating or distributing content on rival platforms, or starting your own educational initiative, without explicit written consent from BharatBIM.
  • This clause applies to all forms of educational activity, including content creation, direct or indirect partnerships, promotional activities, and any other form of business or intellectual property activity.

Professional Conduct:

  • You are expected to maintain a professional, respectful, and courteous demeanour at all times while interacting with students, faculty, and BharatBIM staff. Any behaviour deemed inappropriate or disruptive will be grounds for immediate review of your status with the organization.
  • Mentors must refrain from engaging in personal or political discussions that could hinder the learning environment or reflect negatively on the reputation of BharatBIM.

Prohibited Activities: Mentors are explicitly prohibited from engaging in the following activities:

Claiming ownership of any course content, videos, materials, or promotional content that you create during your tenure with BharatBIM. All such intellectual property belongs to BharatBIM, as per the content ownership clauses.

Using the BharatBIM name, logo, materials, or any proprietary content for any personal or external projects without prior written approval.

Engaging in or facilitating unauthorized collaborations with other educational entities, including offering services or content that could be seen as direct competition to BharatBIM.

Starting or participating in your own educational institution, firm, or business while under contract with BharatBIM.

Additional Staff Policies:

Sandwich Holiday Policy:

  • Mentors and staff members will adhere to a sandwich holiday policy whereby taking leave between two working days will result in the leave being extended to the following days, including weekends and public holidays.

Penalty for Late Joining or Early Leaving:

  • Any mentor or staff member found arriving late to scheduled sessions or leaving early without prior written approval will be penalized according to the severity and frequency of the infraction.

Workplace Equipment:

  • Mentors and staff members are solely responsible for ensuring that they have access to the necessary tools and equipment to deliver their educational services effectively. BharatBIM is not responsible for providing hardware, internet services, or utilities to enable service delivery. Mentors must provide their own laptops, stable internet connection, electricity, and other tools necessary for the work.

Termination Clause:

  • BharatBIM retains the right to terminate a mentor’s contract immediately under the following circumstances:

Unauthorized use or theft of BharatBIM’s intellectual property or materials.

Verified instances of professional misconduct, dishonesty, or abuse of students or staff.

Violation of the exclusivity clause, including working with competing educational platforms.

Content Ownership:

  • BharatBIM retains complete ownership of all content, materials, resources, and any intellectual property produced during the mentoring period. Unauthorized use or distribution of such content post-association will be considered a breach of intellectual property law, and legal action may be pursued.

5. Notice Period Policy for Employees

BharatBIM acknowledges the importance of maintaining a smooth transition during employee departures. To ensure continuity of operations and proper handover of responsibilities, the following Notice Period Policy applies to all employees:

Notice Period Duration:

  • Employees are required to serve a mandatory notice period as per the terms outlined in their employment contract. The standard notice period is 60 days, unless otherwise specified in the contract.
  • In exceptional cases, BharatBIM may agree to a shorter notice period if mutually agreed upon, but the employee must complete the necessary duties and responsibilities as outlined below.

Resignation Process:

To initiate the resignation process, employees must submit a written resignation letter to their immediate supervisor or HR department. The resignation letter should clearly state the last working day, and the employee should provide reasonable notice (60 days) before this date.

Employees are encouraged to have an exit interview with the HR department, where they can provide feedback and discuss their departure in a constructive manner.

Duties Before the Last Day:

Handover of Responsibilities: Employees must ensure that all work, projects, and tasks are properly handed over to the designated colleague or team member. This includes:

  • Sharing detailed notes on current projects.
  • Providing any ongoing work status and timelines.
  • Communicating any pending issues or actions that need attention after their departure.

Knowledge Transfer: Employees are required to conduct a knowledge transfer session with the person who will be taking over their responsibilities. This may include:

  • Training the new person on key tasks or systems.
  • Sharing insights on processes, tools, and software.
  • Ensuring the new person has access to all necessary documents and files.

Documentation: Employees should ensure that all important documents (digital or physical) related to their work, including client files, project data, passwords, and any confidential information, are properly archived or transferred as required. Documents that cannot be transferred should be clearly marked and securely stored.

Return of Company Property: Before their last day, employees must return all company property, including but not limited to:

  • Laptops, mobile phones, and other hardware.
  • Access cards, keys, or any other items issued to them during their employment.
  • Any company-owned software or licenses, including account access credentials, passwords, and licenses.

Final Reporting: Employees must submit a final report or update to their supervisor or HR on the status of all tasks. This report should outline the progress of ongoing work and any relevant details to ensure the continuity of operations after their departure.

Clearance from All Departments: Employees must complete the clearance process with all relevant departments (e.g., finance, HR, IT). This includes:

  • Settling any outstanding payments or dues.
  • Ensuring that all company resources are returned.
  • Updating personal information in the company’s records (e.g., bank details, contact information).

Non-Completion of Duties:

  • If an employee fails to complete the handover process or return company property before their last working day, BharatBIM reserves the right to withhold any final payments or benefits until the duties are fulfilled.
  • In case of non-compliance, the employee may also be subject to penalties or legal action if it causes significant disruption to the company's operations or security.

Exit Formalities:

  • Before leaving, employees must complete the exit formalities with HR, which may include signing off on their resignation paperwork and acknowledging their understanding of their responsibilities during the notice period.
  • HR will conduct an exit interview, where employees are encouraged to provide constructive feedback about their experience at BharatBIM.

Post-Employment Confidentiality:

  • Employees must continue to abide by confidentiality agreements after their departure. They are prohibited from disclosing or misusing any confidential information obtained during their employment at BharatBIM.
  • Any breach of confidentiality after employment termination may lead to legal consequences.

Company’s Right to Waive the Notice Period:

  • BharatBIM reserves the right to waive the employee’s notice period and relieve them from duty earlier than the specified duration, with or without cause. However, employees will still be required to complete all handover duties before their last day.

Non-Compete Clause:

  • Depending on the terms of the employment contract, employees may be bound by a non-compete clause that restricts them from working with competing organizations or starting a competing business within a certain period or geographical region after their departure from BharatBIM.

6. Course Content and Access

BharatBIM offers a comprehensive suite of educational services, encompassing a wide variety of online courses, workshops, certifications, and live training sessions tailored to professionals and students alike. These courses cover a wide array of disciplines, including but not limited to AutoCAD, SketchUp, 3ds Max, V-Ray, BIM (Building Information Modeling), Interior Design, Architecture, and various other engineering and design domains. Each course is crafted to deliver in-depth technical knowledge, practical skills, and real-world applications, designed to help users advance in their respective fields.

Access to Course Content:

  • Enrollment and Access Rights: Upon successful enrollment, users gain access to the specific course materials, live sessions, recorded lectures, and supplementary resources associated with that course. The duration of this access is determined by the terms specified in the enrollment agreement, which is usually tied to the length of the course or training program. Users are granted access to all educational resources for the duration of the course only. Once the course or program ends, access is revoked unless an extension is granted through special arrangements with BharatBIM.
  • Live Sessions and Recordings: Access to live training sessions is available only during the designated class times. For those who are unable to attend live sessions due to any personal reasons, the company is not responsible for any kind of compensation. These recordings are strictly for personal use and are not to be distributed or used for any commercial purposes.
  • Course Materials and Resources: The course materials, including but not limited to PDFs, study guides, lecture notes, tutorials, exercises, and quizzes, are provided solely for the purpose of completing the course. Users are granted a non-transferable, non-exclusive, revocable license to access these materials during the course duration. Unauthorized sharing, duplication, redistribution, or modification of these resources is strictly prohibited and will result in severe penalties, including permanent termination of account access.
  • Updates and Additional Content: BharatBIM reserves the right to update and modify course materials as necessary. Users may be granted access to these updated materials, provided that the course has not yet ended. However, users are not entitled to receive any future course materials beyond the agreed course duration unless they have enrolled in subsequent courses.

Prohibited Activities:

  • Distribution and Duplication: Users, including students and mentors, are strictly prohibited from downloading, sharing, distributing, reselling, or making unauthorized copies of course content, including videos, documents, and any other intellectual property provided through the platform. Any attempt to engage in such activities may result in legal action, and BharatBIM will pursue all remedies available under intellectual property laws.
  • External Sharing: Sharing course materials with third parties who are not enrolled in the course, whether for free or for monetary gain, is a violation of BharatBIM's intellectual property policies and will result in the immediate termination of the user’s account and legal repercussions.
  • Use of Materials Beyond Personal Learning: All materials provided by BharatBIM are meant exclusively for educational purposes related to the enrolled course. Any use of these materials beyond personal learning, including integration into commercial projects or creating derivative works, is prohibited unless explicitly stated in the terms and conditions of a specific course or with prior written consent from BharatBIM.

7. Payments and Refunds

Payment Terms:

  • Course Enrollment: To secure a spot in any course or program offered by BharatBIM, full payment must be made at the time of enrollment unless an EMI (Equated Monthly Installment) option has been selected. All course fees, whether for live sessions, workshops, or recorded materials, must be paid in advance in accordance with the terms laid out during the registration process. BharatBIM reserves the right to refuse access to any course until payment has been successfully processed.
  • EMI Option: BharatBIM offers the convenience of EMI payments, allowing users to pay for courses in installments over an agreed-upon period. The EMI schedule is binding, and users are required to adhere to it. Payments must be made on time according to the agreed-upon dates. Failure to make full and timely payments will result in the loss of access to course materials and services, as detailed in Section 7 (Consequences of Non-Payment).

Additionally, users have a maximum of 40 days from the start of the course to pay the overall principal amount or the remaining due balance. In the case of two-installment plans, the user has a maximum of 25 days to settle the total outstanding fees. If the course duration is less than one month, the 25-day duration will be reduced by 7 days.

  • Taxes: All payments made to BharatBIM are exclusive of applicable taxes, which may vary by jurisdiction. Users are responsible for any taxes, including but not limited to VAT, GST, or other local taxes, that may apply to the payments.
  • Payment Methods: BharatBIM accepts various forms of payment, including but not limited to credit/debit cards, online banking, UPI, and other digital payment methods supported by our payment gateway. Payment processing is handled through a secure payment system that complies with industry standards for data protection and privacy.

Refund Policy:

  • No-Refund Policy: BharatBIM operates a strict no-refund policy. Once a payment is processed,no refunds will be issued, regardless of the student's participation or completion of the course.
  • Exceptional Circumstances: In rare cases, BharatBIM may consider offering a partial or full refund in exceptional circumstances. Such cases will be reviewed on an individual basis, and any decisions made will be at BharatBIM's sole discretion.
  • Course Cancellation: BharatBIM reserves the right to cancel any course or training program if the minimum enrollment requirements are not met or due to other operational reasons. In the event of a course cancellation by BharatBIM, affected users will be given the option to transfer to an alternative course. However, the amount paid for the canceled course will not be refunded.

8. Consequences of Non-Payment or Illegal Activity

Non-Payment:

  • Suspension of Access: If a student fails to adhere to the agreed payment schedule, whether for full payment or EMI payments, their access to all services, course materials, live sessions, and additional resources will be suspended immediately. Students will be notified after the suspension, and their account will remain inactive until the overdue payment is settled.
  • Late Payment Penalties: BharatBIM reserves the right to impose late payment penalties upto 50% on total fees, on students who fail to pay within the stipulated time.
  • Debt Recovery: In cases where payments are not made despite repeated reminders, BharatBIM may refer the matter to a collection agency for recovery. All costs related to debt recovery, including legal fees, will be borne by the student, and their account may be terminated permanently.

Illegal Activities:

  • Fraudulent Activities: Any attempt to defraud BharatBIM or its payment system, including the use of unauthorized credit cards or identity theft, will result in immediate suspension of the user’s account. BharatBIM reserves the right to report any fraudulent activities to law enforcement agencies.
  • Intellectual Property Theft: Users involved in the theft, distribution, or unauthorized reproduction of BharatBIM's intellectual property will face severe legal consequences, including potential criminal charges, civil lawsuits for damages, and permanent termination of their account.
  • Other Illegal Activities: Any illegal activities, including but not limited to hacking, phishing, and violating privacy laws, will be dealt with in accordance with applicable local, national, and international laws. BharatBIM reserves the right to initiate legal action to protect its interests and those of its users.

9. User Conduct

By accessing BharatBIM’s services, users agree to conduct themselves professionally and respectfully at all times. This includes, but is not limited to:

  • Respectful Communication: All communications between students, mentors, and staff must remain respectful, professional, and free from any form of harassment, discrimination, or offensive language.
  • Platform Integrity: Users must not engage in any activity that could harm, disrupt, or interfere with the functioning of the BharatBIM Platform, including introducing malicious software, spamming other users, or attempting to bypass security measures.
  • Collaborative Environment: BharatBIM promotes a collaborative and supportive learning environment, where students and mentors are expected to share knowledge, insights, and ideas in a constructive manner. Any conduct that undermines this environment, including disruptive behaviour or deliberate attempts to sabotage others' learning experiences, will not be tolerated.

10. Intellectual Property

BharatBIM retains all rights, titles, and interests in and to its intellectual property, including all course materials, software, website content, videos, branding, and any other proprietary resources provided through the Platform. These intellectual property assets are protected by international copyright laws, trademarks, and other applicable intellectual property protections. All users of the Platform must comply with these legal protections and adhere to the terms of use outlined in the BharatBIM Terms and Conditions regarding the use of such intellectual property.

Ownership of Materials:

  • Exclusive Ownership: All course content, including but not limited to instructional videos, tutorials, design resources, study guides, project templates, and any supplementary materials provided, are the exclusive property of BharatBIM. These materials are created, compiled, and curated by BharatBIM’s team of subject matter experts, instructors, and content creators.
  • No Commercial Use: Students, mentors, and users of the Platform are granted a non-exclusive, non-transferable, limited license to use the materials solely for the purpose of their personal educational enrichment during the duration of the course or program. Any use of the materials for commercial purposes is strictly prohibited. This includes, but is not limited to, selling, distributing, or publicly performing any of the materials provided by BharatBIM.
  • Modification and Derivative Works: Users are prohibited from modifying, adapting, translating, or creating derivative works based on any of the materials provided by BharatBIM unless explicitly permitted by BharatBIM. Creating derivative works of BharatBIM’s content for personal gain or publication is a violation of intellectual property rights and may result in legal consequences.
  • Protection of Intellectual Property: BharatBIM reserves the right to take legal action against any individual or entity found infringing on its intellectual property rights. This includes instances of unauthorized copying, distribution, or commercial use of its materials. BharatBIM will vigorously protect its intellectual property, and violators may face civil or criminal penalties.

Website and Branding Ownership:

  • The entire content of the BharatBIM website, including the design, graphics, logos, trademarks, text, and multimedia content, is the exclusive property of BharatBIM. Unauthorized use of these assets, such as reproducing, distributing, or displaying BharatBIM’s logo or branding without prior permission, is strictly prohibited.
  • All trademarks and service marks displayed on the BharatBIM website are owned by BharatBIM or its licensors, and no user has the right to use such marks in any way other than as explicitly permitted by BharatBIM.

Course Materials Delivery and Access:

  • Upon enrollment in a course, students are granted temporary access to the course materials for personal educational use. This access is tied to the duration of the course and is revocable at any time upon the completion, suspension, or termination of the course. Users are prohibited from storing, redistributing, or utilizing these materials beyond the course’s timeline unless stated otherwise.
  • BharatBIM reserves the right to modify or update course materials, instructional content, and resources at its sole discretion.

11. Certification:

Upon the successful completion of a course, BharatBIM will provide a certificate to the user. This certificate acknowledges the student’s commitment and the skills they have acquired during the course, showcasing their knowledge in practical, industry-relevant areas. It serves as a valuable tool for personal and professional growth, signifying their readiness to take on challenges in the field.

However, it is important to note that the diploma courses offered by BharatBIM are non-accredited. These courses focus primarily on practical, hands-on learning and professional skills development rather than formal academic education. As such, the diploma certificates provided are not accredited by any government body, including the University Grants Commission (UGC) or any other official authority. These are private certificates awarded by BharatBIM, recognizing the student’s successful completion of the course and their proficiency in the specific areas of study.

The primary focus of BharatBIM’s non-accredited diploma courses is to provide real-world, practical training that prepares students for the demands of the industry. The curriculum is designed to offer extensive knowledge in specialized areas, such as AutoCAD, SketchUp, interior design, and more. The certificate you receive from BharatBIM reflects your expertise and mastery of the skills that are highly valued by employers and professionals in the field.

Positive Aspects of BharatBIM’s Certificate:

  • Industry-Relevant Skills: BharatBIM’s courses are designed to help students acquire up-to-date, practical skills that are directly applicable to their professions. These skills are valued by employers, as they ensure that students are equipped to handle real-world projects and challenges effectively.
  • Hands-On Learning: Unlike traditional academic degrees, BharatBIM’s programs focus heavily on practical application, offering students the chance to engage with live projects and gain hands-on experience. This practical exposure makes the certificate a strong testament to a student's capability to perform in the field.
  • Career Enhancement: While the certificate is not accredited by formal educational institutions, it holds significant weight within the industry, especially in technical and creative fields. Many professionals have found success in their careers after completing BharatBIM’s courses, as the certification demonstrates their commitment to learning and upskilling.
  • Flexibility and Convenience: BharatBIM offers flexible online learning opportunities, allowing students to learn at their own pace and convenience. This approach makes it easier for working professionals or those with busy schedules to pursue education without sacrificing their careers or personal commitments.
  • Comprehensive Learning Experience: Each course offered by BharatBIM is designed to cover a wide range of relevant topics, tools, and techniques. The curriculum is designed by industry experts, ensuring that students are well-equipped with the skills required for success in their respective fields.

It is important to understand that the non-accredited nature of the diploma should not detract from its value. The certificate reflects the practical skills, knowledge, and competencies that the student has developed during the course. It serves as an excellent professional development tool, showcasing a commitment to continuous learning and mastery of industry-relevant tools.

No Job Guarantee: While BharatBIM provides high-quality training, we do not offer a job guarantee at any point in time. The courses are intended to enhance your skill set and increase employability, but actual employment depends on various external factors such as job market conditions, individual efforts, and professional networking. BharatBIM is dedicated to empowering students with the tools and knowledge they need to succeed professionally, but job placement is the responsibility of the student, and we encourage proactive career development efforts.

12. Termination

BharatBIM reserves the right, at its sole discretion, to terminate or suspend user accounts or contracts for any reason, including but not limited to the following:

Non-Payment of Course Fees:

  • Failure to Pay: If a student fails to make the required payments for course enrollment as per the terms specified in the payment agreement, BharatBIM will immediately suspend access to all course materials, live sessions, and other educational resources. This suspension will remain in place until full payment is received. In the case of non-payment for an extended period, BharatBIM may consider this as a breach of the terms and terminate the user’s account permanently.
  • Delayed Payments: In instances where students opt for an EMI payment plan and fail to adhere to the agreed payment schedule, BharatBIM reserves the right to suspend or cancel access to the course content until the outstanding balance is cleared. If the payment delay continues beyond the stipulated grace period, BharatBIM may cancel the student’s enrollment and permanently revoke access to the course.

Violations of Terms and Conditions:

  • Intellectual Property Infringement: Any user found to be infringing upon BharatBIM’s intellectual property rights, including unauthorized copying or distribution of course materials, will face immediate termination of their account. BharatBIM will also pursue legal remedies to protect its intellectual property, which could result in criminal and civil penalties for the violator.
  • Harassment or Misconduct: BharatBIM maintains a zero-tolerance policy for harassment, discrimination, or misconduct in any form. Any student, mentor, or user engaging in inappropriate behavior, such as bullying, offensive language, or discrimination towards other users, will have their account terminated without prior notice. BharatBIM reserves the right to take necessary legal actions against users who violate its code of conduct.
  • Fraudulent Activities: Any user attempting to engage in fraudulent activities, including but not limited to providing false information, using stolen payment methods, or attempting to gain unauthorized access to the Platform, will face immediate expulsion from the platform, and may face legal consequences.

Engagement in Activities that Undermine the Security or Integrity of the Platform:

  • System Security Violations: Users are prohibited from engaging in any activity that could damage, disrupt, or undermine the security and integrity of the BharatBIM Platform. This includes but is not limited to hacking, unauthorized access to other users’ accounts, and attempts to bypass security measures. Any such violations will result in immediate account suspension and permanent termination of access.
  • Malware or Virus Distribution: Users who distribute malware, viruses, or any other harmful software that could damage or disrupt the functionality of BharatBIM’s Platform will be subject to account termination, and appropriate legal action will be taken.

Failure to Comply with Course Attendance or Participation Requirements:

  • Attendance Compliance: BharatBIM has specific requirements for course attendance and participation. Students who fail to meet these requirements may have their access to course materials revoked. In cases of repeated absenteeism or failure to participate in live sessions without a valid reason, BharatBIM reserves the right to suspend or terminate the student’s enrollment.
  • Failure to Complete Course Milestones: Students who consistently fail to meet course milestones, assignments, or project submissions without valid justification may be removed from the course, as this reflects non-compliance with the academic standards set by BharatBIM.

Consequences of Termination:

  • Immediate Loss of Access: Upon termination of a user’s account, the user will immediately lose access to all course materials, live sessions, and any other resources associated with the course. This includes access to any recorded lectures, downloadable course content, and forum discussions.
  • No Refunds: In cases of termination due to non-payment or violation of terms and conditions, BharatBIM will not issue any refund for the course fees, and the student may not re-enroll in the same course unless otherwise approved by BharatBIM.

BharatBIM reserves the right to take such actions without prior notice, and all decisions regarding termination are final and binding. Any user whose account has been terminated will not be allowed to create a new account on the platform, and any future courses or resources offered by BharatBIM will be inaccessible to them.

13. Dispute Resolution

Any disputes arising from the use of the BharatBIM Platform or the interpretation of these Terms and Conditions will be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996. The venue for arbitration will be Nagpur, Bharat.
